Court accepts two more Saxena indictments



Before the end of stature of limitation by next Monday, former Bangkok Bank of Commerce advisor Rakesh Saxena was yesterday indicted with many additional fraud-related crimes in two indictments which caused nearly Bt4 billion in damage, in connection with the entire BBC scandal 15 years ago.

The Criminal Court accepted both indictments, and set a 9 am hearing for Sexena's plea on Monday. The 57-year-old former financier is already facing four trials for fraud and embezzlement he allegedly committed in the mid-1990's, which resulted in the BBC going bankrupt and collapsing.

Saxena will be indicted on another similar charge next week, said senior public prosecutor Seksan Bangsombun yesterday.

The indictment yesterday accused Saxena of committing a series of frauds. In the first act dated February 22, 1995, he, jointly with three BBC executives including Krirkkiat Jalichanra, conspired to obtain a Bt1.52-billion loan on behalf of Saudi businessman Adnan Khashoggi, now on the run, using a collatoral at a lower price. The loan was granted at their joint approval relying on inflated prices of collateral.

Later on March 2, 1995, he and those BBC executives approved extention to a Bt364-million loan guarantee to a purchase of a company using ownership of apartments based in New York and France as new collaterals in place of a previous one using a number of land plots in Phichit province, through forgery and false statements to inflate the price of foreign-based collaterals.

Later on July 25, 1995, he and those BBC executives obtained a US12 million loan through the use of collateral using ownership of land in many European countries based on false deeds and ownership documents. Separately in a period between March 10 and October 5 in the same year, Saxena and those BBC executives illegally used their PIN codes to alter BBC e-accounts to grant an urgent Bt200 million loan to Khashoggi for 10 times, causing a loss of Bt2,003,344,485.67 to the BBC.

In another indictment, Saxena was accused of illegally granting loans totalling Bt1,988,718,475.91 in 266 payments through the use of false documents and colleteral at inflated prices. The indictment demanded Sexena to pay the amount to the BBC and include penalties to be handed on him with those to be ordered in all other indictment he is facing.
