SEC Secretary-General Thirachai Phuvanatnaranubala said in a statement "Once the investment result is available, I'll notify the finance minister as the person who oversees the laws governing the fund."
Thirachai said that urging the SEC to launch further investigation into Visit was the preliminary investigation that showed Visit made stock investment before and after the GPF's investment.
To Thirachai, the investigation will focus on two areas.
It is set out to find if Visit could have violated the Articles 241 under the Securities and Exchange Act, for using inside information for his own investment in stocks that are invested in by the fund. If proved guilty, he is liable to criminal punishment.
It will also find out if Visit did buy stocks in advance of the fund's investment in the stocks. Though this does not violate the securities law, it violated the code of conduct as the fund and the fund's members were taken advantage of. In case of other funds under its supervision, the SEC would reprimand, put them on probation or withdraw licenses.
