The public prosecutors are obligated to initiate the graft trial proceedings within 30 days because the National Anti Corruption Commission has already confirmed the list of seven suspects, Klanarong said.
The seven suspects include former prime minister Samak Sundaravej for his involvement when he led the city administration, and former Bangkok governor Apirak Kosayodhin.
After the NACC had forwarded its report to the public prosecutors, the two sides formed a joint panel for review before forming the conclusion to try all seven suspects, Klanarong said.
Under the antigraft law, the public prosecutors must proceed to try the seven as per the joint panel's recommendation, he said.
The intervention by the attorney general to exclude certain suspects might be unconstitution and in contrary to the spirit of the law, he said.
The public prosecutors said they reached a split decision on the matter and would refer the case to the attorney general for a final review next week.
