LEGAL AMENDMENT

Amendments to Public-Private Joint Venture Act supported

Jaruwan Hengtrakul, a member of the law drafting unit of the Council of State, on Wednesday supports amedments to the Public-Private Joint Venture Act, citing some practical problems which result in project delays.

She said that the amendments are necessary to speed up the private participation in the public projects.

The State Enterprise Policy Office and the National Economic and Social Development Board would need to discuss on potential amendments.

"The law has the broad definition of projects to come under the law with unclear wording. More clarity is necessary, also in terms of the value of the projects. Excluded from the law is the process to revise 20 and 30-year concessions as well as the process to cover any business revision. As such, any change needs the Council of State's interpretation which brings all to square one and leads to further delays," she said.
