
The suggestion came from the Office of the Attorney General (OAG).
"Although we could take the case to the Civil Court by ourselves, it is better to listen to the OAG," Sukhumbhand said.
The OAG said it would need to discuss the validity of the purchase contract with the National AntiCorruption Commission (NACC) before making any legal move.
The NACC says the deal is mired in corruption.
Earlier this week Sukhumbhand was adamant that the court should either void the contract or at least prevent the next instalment from reaching the supplier.
The next instalment of Bt750million is due next week.
"I am sad that we have to pay the money, but we shall be able to get it back when we eventually do void the contract," he said.
