Court to decide on caretaker premier


The Constitution Court will hand down on Tuesday its decision on whether Deputy PM Chaovarat Chanweerakul is qualified to perform as caretaker prime minister, the court secretary-general said yesterday.

"By Tuesday, the high court should have the answer on Chaovarat's job status," Paiboon Warahapaitoon said.

The judicial review is based on a petition submitted by 24 senators through the Office of Parliament President.

The petition seeks to clarify three issues - whether the removal of Somchai Wongsawat as PM led to the collapse of the government, whether the Cabinet has the legal authority to name Chaovarat as caretaker prime minister and whether party-list MPs are disqualified from office in the wake of a party dissolution.

The high court has decided not to rule on the qualification of party-list MPs on the ground that the Constitution does not sanction the upper chamber to interfere with the jurisdiction of the House.

Should doubts linger on the status of party-list MPs, relevant agencies, such as the House and the Election Commission, have the mandate to petition for a legal interpretation by the high court.
