Charan faces impeachment complaint

A legal specialist on Tuesday filed a complaint with the Senate to launch impeachment proceedings against Constitution Court judge Charan Pakdithanakul, accusing him of lacking qualifications since he was hired as an "employee" for several private businesses.



Picha Vichitsil filed the complaint with Senate Speaker Prasopsuk Boondej to impeach Charan and other Constitution Court judges who may have lacked qualifications on the same grounds.

He claimed the Constitution Court ruling that disqualifed Samak Sundaravej as prime minister must be used as a norm to be used in interpreting an "employee" in other Articles of the Constitution. Samak was found guilty of breaking Article 267 of the Constitution because he was an employee of companies, hosting a cooking programe and a radio talk show.

He said Charan had held many posts in several universities and hosted a radio programme "Kluean Kwam Kid" or Thought Wave on FM 96.5. In doing all those works, he was paid wages and remuneration. Thus he had violated Article 207 (3), resulting in him being disqualified as Constitution Court judge in accordance to Article 209 (5) with immediate effect.

Picha denied he acted with the backing of any politicaly parties but he did it because the judges would soon rule on the dissolution of the People Power Party and others. If the judges are not qualified to carry out their duties, the dissolution trial against those parties could be nullified.
