Chief prosecutor's role questioned in Thaksin case

Democrat MP Korn Chatikavanij yesterday petitioned that an investigation be started to see if the chief prosecutor had abused his power by deciding not to prosecute ousted PM Thaksin Shinawatra in the SC Asset case.



Korn asked the National Counter Corruption Commission to investigate Seksan Bangsomboon and find out if he had made a prejudiced decision in favour of Thaksin.

He claimed that Seksan had failed to justify why he had overruled the report prepared by the Department of Special Investigation (DSI), which recommended Thaksin be tried for violating the disclosure rules prescribed by the Securities and Stock Market Act of 1992. He said Seksan's arguments were unclear and might go against the securities law.

After Seksan's decision, the case was returned to the DSI for a second review. Should the DSI concur with the prosecutor's decision, the case will be dropped, otherwise the case will be forwarded to the attorney general whose decision would be final.
