EC asked to rule against Apirak
Bangkok Eelection Commission chairman Ping Rungsamai said his commission yesterday resolved to seek the Election Commission ruling on whether Democrat Party's gubernatorial candidate Apirak Kosayodhin committed an electoral offence by putting pictures of Bangkok Metropolitan Administration (BMA) officials in his election campaign posters without consent.
The Bangkok Election Commission members believed the case had merit. "We believe the case has enough evidence,'' he said.
The case would be submitted to the EC within next Monday (6) the latest, he said.
A source said the Bangkok EC believed the case has grounds for prosecution but the five EC members may have different opinion from his commission. If that is the case, the EC may appoint a sub-panel to probe the allegation which may take at least 30 days to come up with a finding. If the EC resolved that Apirak committed electoral offence, he could be red-carded or yellow-carded if he wins the gubernatorial election.
If the pictures were from the Bangkok Metropolitan Administration's Office of Public Relations, Apirak could face legal action for using state assets in his election campaign.
Besides this issue, Chuwit Kamolwisit, an independent gubernatorial candidate also filed another complaint requesting the Bangkok Election Commission and the EC for the the removal of election posters of the Bangkok Metropolitan Administration that carried the name of Apirak.
The BMA's Office of Public Relations and Office of Traffic and Transport, were responsible for the election posters with Apirak name that were stuck on garbage bins and bus stops across the capital. Both offices were required to remove them when Apirak's term ended.
The EC could take recourse to Article 60 of the election law against BMA officials involved for abuse of authority by carrying out activities in favour or in bias against any candidate, which is punishable with imprisonment for up to 10 years.
