Injunction hearing on PAD-led protest suspended

The Civil Court on Wednesday suspended a hearing on whether to issue an injunction on the rally organised by the People's Alliance for Democracy pending the reviews of pertinent legal issues by two high courts.



A group of six education officials have petitioned the lower court to ban protest activities on Makawan Rangsan Bridge from 8.30 am to 4.30 pm on working days and to relocate the rally site away from the Education Ministry.

The six contend that the rally has disrupted their work and blocked traffic.

PAD's lawyer Suwat Apaisak contend that the injunction, if issued, will violate the right to a peaceful assembly as sanctioned by the Constitution and that the litigation on public demonstration is an administrative dispute and not a civil case.

The court ruled to forward the constitutional right to peaceful assembly for review by the Constitution Court. It also decided to seek the legal opinion of the Central Administrative Court in regard to judicial jurisdiction on the case.
