PAD appeals road blockade, noise ban

The Civil Court has scheduled this afternoon to decide whether to lift its injunction ordering the People's Alliance for Democracy to stop blocking roads and using sound systems during school hours.



On Monday, the court granted the injunction to 10 teachers and parents from Rachawinit Secondary School, located next to the PAD rally site near Government House, after their request last week.

After PAD's petition to overturn the injunction, the court yesterday spent almost all day hearing testimonies from the group's representatives including Chamlong Srimuang, Pibhop Dhongchai and Nakhon Chompoochart, a human rights committee member from the Law Society of Thailand.

Maj-General Phanu Kerdlarp-phol, deputy metropolitan police commissioner, said he was ready to talk to the Legal Execution Department and ask PAD to comply with the court's injunction.

PAD only lifted barricades in some traffic lanes and had not fully opened roads so that people could commute conveniently as the court had ordered, he said. Traffic on Rama V Road was able to travel only one way while protesters' tents still blocked Phitsanulok Road.

Last night PAD blocked the roads and continued their stage programme as normal. In court, PAD leaders and its coordinator cited their constitutional rights and duties and argued that their rally was beneficial to the country in many ways.

The lawsuit was filed against the five PAD leaders - Sondhi Limthongkul, Somkiat Pongpai-boon, Somsak Kosaisuk, Chamlong and Pibhop - as well as its coordinator Suriyasai Katasila.

The plaintiffs accused the defendants of infringement of their rights. They sought to have the defendants remove the stage and other structures obstructing traffic on Rama V and Phitsanulok roads as the road blockade and loud noise from the protest were in violation of their rights, although the defendants were exercising their constitutional rights in holding the protest.

Section 28 of the 2007 Constitution states that : [A person can invoke human dignity or exercise his rights and liberties in so far as it is not in violation of rights and liberties of other persons or contrary to this Constitution or good morals] The PAD's occupation of the roads is in violation of rights and liberties of other persons who want to use the roads. Section 63 :[A person shall enjoy the liberty to assemble peacefully and without arms. The restriction on such liberty under paragraph one shall not be imposed except by virtue of the law specifically enacted for the purpose of public assembling and for securing public convenience in the use of public places] The civil court's injunction is for securing public convenience in the use of public places. In civilized societies all over the world,peaceful demonstrations and peoples rally is right against what they feel is abnormal.How come in Thailand is not the same?Have the PAD rallies been blown out of proportion by those that hate them,especially the joint government of Thaksin and Samak.Why are they bent on violating peoples rights to demonstrate?Is such peaceful rallies illegal in Thailand?In what context,if I may ask?Or is the power-brokers involved in these Court injuctions also?Infact,Thailand Justiciary system should wake up,because we are seeing on daily basis the violations of both the Executive as well as those reckless,dishonest and insincere people in Parliament.So,the Judiciary should be different from those bought over with Thaksin Shinawatra's stolen millions.

It is not clear if they can still occupay the road other than the hours 0730-1640 according the the court order. Why is it important given PAD's rally only attracted the people in the night time? Besides I don't think that their rally is unneccessary for this country. You can immaine that if PAD had not have taken to the street what had happened to this country now. There is no proper law enforcement and no media beeing able to give criticism to the goverment. Your aveage citizen should khow how abronma situation you are in. And if you think the rick and powerful will be able to solve the problems if you sit by and cross your fingers, you are wrong.

By citing the constitutional rights, the PAD simply ignoring the hardship of the students, teachers, businesses and other average citizens around the area. Although PAD is free to make their protests, they are not free to create problems and inconveniences to the public. It is about time that the court stops PAD's way of protest and return some normalcy to the area.
