Cabinet to consider iTV today

The Attorney General's Office said yesterday there were three points to consider in any final settlement following the Supreme Administrative Court's ruling on iTV.
OAG spokesman Atthaphol Yaisawang said the first point was whether there would be out-of-court settlement between iTV and the Prime Minister's Office, which granted the 30-year concession to the television station. This may be known following today's Cabinet meeting.The second point was whether the Bt94.96-billion fine, as calculated by the PM's Office, would be regarded as a conflict on strategic details in the original concession deal - a condition might require arbitration. The third point was that the Administrative Court could enforce immediate payment of both the fine and the overdue debt of Bt2.21 billion in annual concession fees for almost three years iTV failed to pay the PM's Office - or whether arbitrational sanction would still be needed to enforce the payment. Atthaphol said an OAG panel that worked on the issue - with Sa-nguan Tiyaphaiboolsin, a deputy attorney general and two other executive public prosecutors as members - would need to hear the Cabinet's decision on iTV today before deciding what to do next with the matter. The spokesman said he believed the court verdict was complete and had an immediate effect on iTV. He personally believed that a fair decision could be arbitrated on cases involving conflicts of interest between state agencies and concessionaires.
