ITV Controvery

The Supreme Administrative Court will rule on Wednesday if the Administrative Court was entitled to overturn an arbitration decision concerning the concession contract of broadcaster iTV. The following is the timeline of the controversy.

1995 - iTV was created to foster independence in journalism following the pro-democracy uprising of May 1992 as a brainchild of the Office of the Permanent Secretary of the PM's Office.

Siam TV and Communication Company which consisted of Siam Commercial Bank and Nation M ultimedia Group was granted 30-year concession since July 3, 1995. The official boardcast of iTV started in July 1996 and the concession will end in July 2025. It has been on air for 11 years.

October 1998 - The iTV Plc has been listed in stock exchange market.

November 2001 - Shin Corp became the biggest shareholder of iTV as owned 53-per-cent of the boardcaster's stake.

September 17, 2002 -iTV submitted an appeal with the Arbitration Court seeking its ruling on the station's dispute with the Prime Minister Office over terms of concession contract.

January 30, 2004 - the Arbitration Court allowed iTV to pay a lower fee and adjust its contents more towards entertainment. iTV won consent to to pay an annual fee of either 6.5 per cent of revenue or Bt230 million, whichever is higher, in a drastic cut from an original rate of 44 per cent or Bt1 billion a year, whichever is higher. The court also allowed the station to adjust its news/entertainment programming ratio from 70:30 to 50:50.

However, the PM Office appealed to the Central Administrative Court, which on May 9 overruled the arbitration panel's decision. The broadcaster has appealled the ruling to the Supreme Administrative Court. In the meantime, it has refused to pay the original concession fee to the PM's Office.

PM's office demands iTV for the immediate payment of Bt76 billion in penalties, Bt1.7 billion in backdated concession fees and this year's concession fee of Bt1 billion, despite iTV's pending appeal with the upper court.

ITV has the most network stations of 52 situated across the country and has reached 98 percent of the country people

January 2006 - Shin has been taken over by a group led by Singapore's state investment arm Temasek Holdings, when the family of then Prime Minister Thaksin Shinawatra disposed of its majority stake to Temasek.

May 9, 2006 - To an appeal by the Office of the Permanent Secretary of the PM's Office, the Central Administrative Court overruled the Arbitration Court's decision on the case, ordering iTV to stick to the original concession fee rate - 44 per cent of revenue or Bt1 billion a year - whichever was greater.

The Court also called for backdated concession fees of about Bt1.7 billion to be paid. iTV was ordered by the Central Administrative Court in May to pay Bt70 billion for breaching its contract with the government. iTV was required to readjust its news-to-entertainment ratio from 50-50 to 70-30.

June 8, 2006 - iTV lodged an appeal against the Central Administrative Court's ruling with the Supreme Administrative Court. It argued that it would no pay the fee rate until the Supreme Administrative Court rules on the case.

December 13, 2006 - The Supreme Administrative Court will rule on Wednesday if the Administrative Court was entitled to overturn an arbitration decision concerning the concession contract of broadcaster iTV.
