Court to rule on NCCC 5 shortly

The Constitution Court is scheduled to rule on the qualifications of five National Counter Corruption Commission (NCCC) candidates on September 26, court secretary-general Paiboon Warahapaitoon said yesterday.
After a meeting of court judges, Paiboon said that an explanation had been received from former Suan Sunantha Rajabhat Univer-sity rector Dilok Bunruangrod, the last of five whose qualifications were in question. The judges discussed the case and court president Ura Wang-ormklang told them to write individual judgements. Further discussion could be held before they read their judgements and vote for a joint verdict on Sept 26. The court was asked to rule on whether the five nominees for the anti-graft body were actually qualified, as the Constitution states an NCCC commissioner has to hold the rank of director-general, or equivalent, in the civil service. The selection panel considered the five nominees as qualified, but the Senate questioned the definition of "equivalent" and asked the Senate Speaker to seek a ruling. The four other nominees are NESDB deputy secretary-general Santi Bangor, Deputy Auditor-General Sajja Sasanawin, Basic Education Commission deputy secretary-general Areerat Watanasin and National Police Commission asst commissioner Lt-General Wanchai Srinualnad. Paiboon said the ruling would cover only what had been asked and it would not necessarily be the standard for other cases. However, the case could affect the status of other members of other independent organisations. Constitution Court judges Suwan Suwanwecho and Suthee Sutthisomboon had withdrawn from adjudicating on the case as their qualifications were also in question.
