Appointments overruled

The Supreme Administrative Court yesterday upheld a lower court's order overruling two Finance Ministry orders five years ago that appointed four senior Revenue Department officials as deputy directors-general, saying they were promoted without undergoing mandatory training and performance appraisals.
The court also altered a condition in the lower Administrative Court verdict that invalidated a regulation mandating the selection process that led to the two appointment orders on the days they were issued, in September 2001 and May 2002, respectively. Yesterday's ruling said the regulation would be invalidated retroactively as it would be unfair to other civil servants who were lawfully promoted under conditions stipulated by the regulation, made effective in August 2001. Under the two appointment orders, Janthima Sirisaengthaksin, Chornant Phetyaphaisit, Wichai Juerngrakkiat and Bunsak Chiampreecha were promoted to be deputy directors-general. But the lower Administrative Court recently ruled the orders invalid, after it agreed that all four officials lacked the qualifications for the positions after Phairat Sahamethaphat, a candidate for the post who was not selected, filed a complaint with the court.
