Lawyer takes his anti-Constitution Court case to the ombudsman

A lawyer yesterday complained about the performance of the Constitution Court judges when they annulled the April 2 election.

Picha Wijitsilp, a lawyer from the Niti Ekaraj law office, said he disagreed with the Constitution Court's ruling because the court did not have the authority to rule on general lawsuits.

He asked the ombudsman to look into the matter.

After complaining to the ombudsman, Picha then went to the Election Commission's headquarters to submit a letter to chairman Vasana Puemlarp.

He said he was not fearful that his actions might be libellous against the Constitution Court.

"If I was jailed because of my actions, that's fine - one day I'll be freed from jail," he said.

"I'm ashamed that foreign lawyers claim Thailand is administered according to democracy, when in fact it is not," he said.

Oct 22 poll date falls in Ramadan

The Office of the Election Commission (EC) is considering postponing the next election and refunding application fees for all MP candidates submitted since the April 2 election was nullified, a source said.

The source said the proposed October 22 date for the new election was "not convenient" for Muslims because it fell during Ramadan.

The office will propose that the EC call a meeting of political parties to re-schedule the election. The office wants to refund MP candidates the Bt10,000 application fee but fear allegations that its proposal will only favour the Thai Rak Thai Party since most MP candidates are from the party.

The office decided that it would let the Political Party Fund Committee rule on the matter.

Nullified poll

Democrats demand Bt2 bn in suit

The opposition Democrat Party will press the Finance Ministry to file criminal and civil suits against outgoing Prime Minister Thaksin Shinawatra and the Election Commission for their handling of the nullified April 2 election that cost the state more than Bt2 billion.

Democrat Party deputy leader Alongkorn Polabutr said the party would take recourse in the Conviction of Offence by State Officials Act 1996 to demand Thaksin and the EC repay Bt2-billion compensation to the state. The party will also take recourse in Article 157 of the criminal law, for alleged criminal offences committed by Thaksin and the EC in the same case.

He said if the court found both parties guilty as accused, they would have to share the payment of compensation.
