TOT to appeal True award

TOT Plc is to file an appeal to the Central Administrative Court on April 21 seeking to overrule last month's decision of the Arbitration Court that it must pay more than Bt9 billion in network access compensation to True Corp Plc.
TOT president Teerawit Charuwat said yesterday that TOT was also proceeding with plans to terminate True's fixed-line telephone concession, which is granted by TOT. True filed its case against TOT in August 2002, claiming a share of benefits gained by TOT from providing special services on True's network. The Arbitration Court ruled in True's favour, and said that for lost revenues up to August 22, 2002, TOT had to pay True a sum of more than Bt9 billion, plus interest, within 60 days. For the ensuing period, TOT must pay True 50 per cent of the benefits gained by TOT from accessing its network. TOT then said it would not only appeal to the Central Administrative Court, but would also terminate True's concession, saying that True has violated the contracts many times. TOT is now pursuing the termination process through the Attorney General's Office.
